1. Overview

2. Data Protection

We are committed to protecting your personal data in accordance with applicable laws, including the Turkish Personal Data Protection Law (KVKK - Law No. 6698) and the General Data Protection Regulation (GDPR). By using our Service, you consent to the collection and use of your information as detailed in our Privacy Policy.

3. Payment Processing

All payments for our services are processed securely through our integrated payment gateway using industry-standard encryption and PCI DSS compliant infrastructure. When you make a purchase, your payment information is handled directly by the payment processor — we never see, store, or have access to your full credit card details.

Upon successful payment, you will receive a confirmation and a receipt/invoice for your records. All prices are listed in USD.

4. Services & Digital Products

Aceris Studio provides digital product design and development services. Each purchase constitutes the delivery of a defined set of digital deliverables ("Digital Products") as specified in the selected package. Our packages include:

• The Seed — Quick Launch: A custom-designed landing page with UI/UX design, Google Business Profile setup, on-page SEO, schema markup, and speed-optimized mobile-first code. Delivered as production-ready source code, a deployed website on Vercel, and full transfer of codebase ownership.
• The Core — Professional Presence: Up to 5 custom-designed pages with CMS dashboard, analytics integration, advanced SEO strategy, and 30-day post-launch support. Delivered as production-ready source code, CMS access infrastructure, a deployed website on Vercel, and full transfer of codebase ownership.

Additional packages (Identity, Ultra) will be made available in the future. The specific deliverables for each package are described on our pricing page.

5. Orders & Payment

All payments are processed securely through our integrated payment gateway. By placing an order, you agree to provide accurate billing information. All prices are listed in USD. Applicable taxes are calculated based on your location and applicable regulations.

Upon successful payment, you will receive a confirmation email and gain access to your client dashboard where you can submit project details, upload assets, communicate with our team, and track project progress in real-time.

6. Pricing & Availability

We operate a slot-based availability system. A limited number of project slots are available at a discounted early-access price. Once all slots are filled, the standard price applies. Slot availability is displayed in real-time on our pricing page and reflects actual capacity — we do not use artificial scarcity.

We reserve the right to modify prices at any time. Price changes will not affect orders that have already been placed and paid for.

7. Project Delivery

We aim to deliver projects within the estimated timeline communicated at the time of purchase (approximately 5 business days for The Seed; approximately 14 business days for The Core). However, delivery times may vary depending on the complexity of your requirements and the completeness of information provided during onboarding.

The project lifecycle follows these phases: (1) Purchase Complete → (2) Onboarding Submitted → (3) Design in Progress → (4) Client Review → (5) Delivered. You can track your project phase in real-time through your client dashboard.

Each package includes revision rounds as described in the package details. We are committed to your satisfaction and will work with you through the revision process to ensure the final product meets your expectations.

8. Intellectual Property

Upon full payment and final delivery, you receive full ownership of the delivered website design, source code, and custom assets created specifically for your project. This includes the right to use, modify, and distribute the deliverables without restriction.

We retain the right to showcase the project in our portfolio and marketing materials unless you request otherwise in writing within 14 days of delivery.

Any third-party assets (fonts, stock images, open-source libraries, plugins) used in your project remain subject to their respective licenses. We will provide documentation of any third-party assets and their license requirements upon delivery.

9. Client Responsibilities

You agree to provide necessary content, assets, brand guidelines, and feedback in a timely manner. Delays in providing these materials may affect the project timeline and do not entitle you to a refund or deadline extension.

You are responsible for the accuracy and legality of the content you provide. You warrant that any materials submitted do not infringe on third-party intellectual property rights or violate any applicable laws.

10. Acceptable Use

You agree not to use our Service to:

• Engage in any unlawful, fraudulent, or harmful activity.
• Submit false or misleading information during onboarding.
• Attempt to gain unauthorized access to our systems, client dashboards, or other users' data.
• Resell, redistribute, or sublicense our services without prior written consent.
• Use the delivered products for any purpose that violates applicable laws or regulations.

11. Refunds & Cancellations

Our refund policy is detailed on our Refund Policy page. In summary:

• Before design starts: Full refund within 48 hours of purchase.
• During design phase: 50% refund.
• After final delivery: No refund.

Refund transactions are processed through our payment gateway and typically appear on your statement within 5–10 business days.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Aceris Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services, including but not limited to loss of profits, data, business opportunities, or goodwill.

Our total aggregate liability for any claim arising from or related to these Terms or our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Aceris Studio, its owner, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of our services, your breach of these Terms, or your violation of any applicable law or third-party rights.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey (including the Turkish Personal Data Protection Law No. 6698), without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Eskişehir, Turkey.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced by a valid, enforceable provision that most closely matches the intent of the original.

16. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Aceris Studio regarding the use of our Service and supersede any prior agreements or understandings.

17. Modifications

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms. For material changes, we will make reasonable efforts to notify users via email or a prominent notice on our website.
